TERMS & CONDITIONS (THE "TERMS")

These are our Terms which you should read before you use our site or before you register as a Member (defined below).

This website (www.onlinetraveltraning.co.uk/visitpoland.aspx, hereinafter called the “Site”) is owned by the Polish National Tourist Office in London (“we/us/our”).

These Terms are a legally binding agreement between us and you. They will govern the relationship between you and us and everything that you do on the Site.

If you do not accept the Terms, you should not view, access or otherwise use any part of the Site. In such a case, please leave this Site now.

Acceptance of Terms
These Terms govern your use of the Site, the information that we make available to you on the Site and any items or services that we sell you directly from this Site. These Terms do not govern any other relationships with any third party. If you are entering into a contract with a third party, you ought to read their Terms carefully before entering into an agreement with them. You accept that you will be bound by these Terms and any changes that may be made to them from time to time. If you do not agree to be bound by these Terms, please exit the Site immediately.

In order to gain access to the Site you may need to enrol as a member (“Member”) of the Site.

We may update these Terms from time to time and it is your responsibility to ensure that you are up to date with them at all times. Please note that your continued use of the Site will indicate your acceptance of any such updated Terms.

These Terms are made according to English law (and applicable European law) as we are a United Kingdom Site.

Member’s age
It is assumed that you are aged 18 years or older. If not, please contact Online Travel Training Ltd. for guidance if you qualify to use this site.

Registration Information and Your Privacy
When you register as a Member or request us to provide you with certain materials or information, you may be required to provide us with your full name, your member name, your address, your post code, your email address and your chosen password (the "Registration Information"). In the event that you do not provide us with the Registration Information we may refuse your request. We use the Registration Information as detailed in our Privacy Policy.

Provision of Service
This Site may be modified or discontinued by us with or without notice to you and without liability to you or to any third party (except where any such action taken by us causes you to suffer loss or death or personal injury as a result of our negligence). The Site is made available to you strictly on an “as is” basis.
We do not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within these materials we shall not be liable for any special, indirect, incidental, or consequential damages, including without limitation, lost revenues or lost profits, which may result from the use of these materials.
We are not responsible in any way for the accuracy or otherwise of information posted onto the Site by third parties. We are also not responsible for the contents of any site that you may go to via links from our Site.
If you become aware of any information on Site which you know or have good reason to suspect is untrue or incorrect in any way please let us know by contacting us.

Your Obligations to Us
You agree that you will only use the Site in such a way that adheres to these Terms.

Intellectual Property Rights and Use of Site
Copyright and design rights extend to the design, look and feel of our Site, all photographs and text appearing on it and any promotional material and we assert our Intellectual Property Rights therein.
We do not give you any right or interest in any copyright, trade mark, trading style, trade name, goodwill, design right, patent, database, software right, whether registered or unregistered ("Intellectual Property Rights") in any text, image, logo, trade mark, table, compilation, database, software or other material in which Intellectual Property Rights subsist featured on the Site because they are owned by Us. You can use all the material on our Site and you may use, replicate, copy, modify, distribute or adapt any area of the Site only to the extent we specifically say so.
We do not give you any rights in relation to any Intellectual Property Rights in any product or service that you purchase on or download from the Site and nor do we give you right to reproduce the same, whether free of charge or on a paid for basis.

We do not make any warranty or representation in respect of the ownership or origin of any third party materials included on the Site.

All copyrights and trademarks being the property of third parties are hereby acknowledged.

Prices and Deliveries
Any services and any items such as promotional materials, brochures, posters, maps, magnetic and optical media, gadgets and items of similar nature (the “items”) that may be offered from time to time through this Site, shall be offered entirely at our discretion and we shall not be bound by any obligation to deliver all or any of the services or items to you.

Any items ordered for postal delivery in quantities reasonably considered as being ordered for personal use, will be sent to you free of charge. We reserve the right to determine the quantities which may be considered as such, and may charge you to reimburse our cost of delivery of items ordered for commercial or other non-personal use. We will ensure that all reasonable steps have been taken to deliver the items ordered by you as soon as practically possible. Risk in the items passes to you upon delivery.

Please note, however, that for postal delivery we use the Royal Mail to deliver items to you and we dispatch them to you as soon as possible after you place an order with us. Please note that although we send all items by post we are reliant on the Royal Mail and once the items are in their possession we are unable to guarantee a delivery date to you. Please order from us in enough time to prevent any loss or disappointment resulting from any delay in the delivery time.

We reserve the right not to deliver to places outside the UK and the Republic of Ireland.

Description and suitability of items and services
All items and services are provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Competitions
Competition that will be run on the Site may have their own rules and you agree to follow those rules. Please read them carefully before entering a competition.

We will use your Registration Information to contact you in the event that you win a competition and/or to deliver to you your prize. Please read our Privacy Policy in relation to use of your personal information.

We are not responsible for any competition or game run by any third party which you access via our Site.

Qualifying Entrants
To qualify to enter the Competition you must be resident in the United Kingdom or the Republic of Ireland. The address you provide with your competition entry ("Entry") will be used to contact you about any prizes so please make sure this is correct.

Employees of any company involved in the running of the Competition, agents or members of their families or households, are not eligible to enter the Competition.

Where the Competition prize includes travel outside the United Kingdom or Republic of Ireland and/or car hire, additional eligibility requirements may apply, e.g. possession of a valid passport, visas and/or driver's licence.

By entering the Competition, you hereby warrant that all information submitted by you is true, current and complete. We reserve the right to verify the eligibility of all entrants.

Where the Competition is open to all age groups, we assume that by using the Site and entering the Competition (and you warrant that) you are aged 18 or over or, if you are under 18, that your parents have consented to your entry into the Competition and these Rules. If the Competition is only open to a certain age group, this will be set out in the Competition Notice and we assume that by entering the Competition (and you warrant that) you are the appropriate age to enter the Competition).

We reserve the right to disqualify any entrant if we have reasonable grounds to believe the entrant has breached any of the Terms.

In the event that any entrant is disqualified from the Competition, we in our sole discretion may decide whether a replacement should be selected. In this event, any further entrant will be selected on the same criteria as the original entrant and will be subject to these Terms.

Competition Entries
Only one entry per person per Competition is allowed (except where the Competition Notice states that more than one entry can be submitted) and any entrant who enters more than the permitted maximum will be disqualified. Where a winner has been selected and we discover or have reasonable grounds to believe the winner has made more than one Entry, we reserve the right to select an alternative winner. Any further winner will be selected on the same criteria as the original winner and will be subject to these Terms.

Competition entries must be made in the manner and by the closing date specified on the Site or in the Competition Notice. Failure to do so will disqualify the entry.

Prizes
Prizes are offered either by us or by our carefully selected partners acting as a third party (“Partners”).

Prize winners will be chosen at random unless specified otherwise in the Competition Notice. In all matters, our decision as to the choice of the prize winner or winners shall be final and no correspondence or discussion shall be entered into.

Prize winners will be notified within reasonable time using the channels of communication available through the Site or otherwise (“Notification”). Return of any Notification as undeliverable or failure to reply as specified in the notification (and within the time stated) may result in disqualification and selection of an alternate winner. If more than one prize is awarded, only one prize per entrant will be awarded. Competition winner(s)’ names may be published on the Site.

Claims for prizes must be made in the manner and within the time specified in the Notification. Failure to claim a prize within this time or in the manner specified may result in disqualification and selection of an alternate winner.

Prizes are non–transferable and there is no cash alternative.

Prizes are awarded at our discretion and we shall not be bound by any obligation to deliver all or any of the prizes to you. We reserve the right to substitute prizes of equal or greater value at any time.

Where a prize may not be appropriate for a younger contestant, we reserve the right to request written proof of age of any winner.

All taxes, insurances, transfers, spending money and other expenses (including accommodation, meals or personal expenses upgrades etc.) as the case may be, unless specifically stated, are the sole responsibility of the prize winner.

Description and suitability of prizes
All prizes are provided "as is" without warranty of any kind, either express or implied, including but not limited to, the implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

Liability
We cannot accept any responsibility for any damage, loss, injury or disappointment suffered by any entrant entering the Competition or as a result of accepting any prize.

We disclaim all liability whatsoever, whether arising in contract, tort (including negligence) or otherwise in relation to any items and services offered on this Site in the form of a prize by our Partners; and all implied warranties, terms and conditions relating to the prizes (whether implied by statute, common law or otherwise), including (without limitation) any warranty, term or condition as to accuracy, completeness, satisfactory quality, performance, fitness for purpose or any special purpose.

We shall not be liable, in contract, tort (including, without limitation, negligence), pre-contract or otherwise, as a result of or in connection with any items and services offered on this Site in the form of a prize by our Partners for any:

- economic loss (including without limitation loss of revenues, profits, contracts, business or anticipated savings); or
- loss of goodwill or reputation; or
- special or indirect or consequential loss.

Some prizes may differ from their description or appearance on the Site. We will not be liable for any indirect or consequential loss to you arising out of your use of the Site or your use of any information available on the Site.

Publicity
Winners may be requested to take part in promotional activity and we reserve the right to use the names of winners, their photographs and communications from and to them in any publicity.
